I think mothers who intend having the baby should avoid consuming products that are likely to leave the child with debilitating conditions eg heroin babies. So I would say that excessive drinking should not be allowed during a pregnancy.

My boyfriend refused to serve a heavily pregnant woman once and in fairness she didn't argue with him.

She was probably mortified.
My GF had the occasional bottle of beer (she went right off the taste of wine) when pregnant. It might have been one every month or two.
I hope that woman had obviously had some others before ordering.

She was always drunk, I suppose I should have explained that! The child died. One or two pints is no harm.

He won't.

The difference between those situations is that with regard to those utilizing that argument in an anti-gay-marriage movement, they were demonstrably wrong. On the other hand there is no doubt that excessive alcohol consumption damages babies.

Forgetting issues of enforcability, what do you consider the moral difference between punishing a mother of a baby whose drinking resulted in physical harm to that baby and doing the same to a woman whose viable child was still in-utero?
